  2. The Ministry of Health of the Kyrgyz Republic (hereinafter referred to as the Ministry) is the central executive body, pursuing the state policy and executing governance in the area of citizens’ health protection in the Kyrgyz Republic.
  3. The Ministry in its activities shall be guided by the Constitution of the Kyrgyz Republic, Laws of the Kyrgyz Republic, decrees and orders of the President of the Kyrgyz Republic, decrees and orders of the Government of the Kyrgyz Republic, other regulatory legal acts, as well as this Regulation.
  4. The Ministry is a legal entity with its title in the state and official languages, has its seal with the State Emblem of the Kyrgyz Republic and settlement accounts in the Treasury under the Ministry of Finance of the Kyrgyz Republic.

 

  1. Goal of the Ministry
  2. The goal of the Ministry is to protect and promote health of citizens in the Kyrgyz Republic.

 

  1. Objectives of the Ministry
  2. The objectives of the Ministry are development and implementation of state policy on:

- improving quality and ensuring accessibility of the population to health care services;

- public health;

- development of public-private partnerships in health sector;

- improving budget-insurance medicine.

  1. Functions of the Ministry
  2. In accordance with the assigned objectives, the Ministry shall perform the following functions:
  3. a) functions of sector policy:

- develops and implements national, state and targeted programs in the field of health protection and promotion, programs of state benefits, monitors and evaluates their progress;

- develops the drafts for regulatory legal acts in the field of healthcare and submits them to the Government of the Kyrgyz Republic;

- defines the scope and conditions for delivery of health care;

- carries out activities to optimize and restructure health care organizations;

- monitors and evaluates the activities of providers of health and pharmaceutical services, regardless of ownership;

- takes part in development and implementation of measures on adaptation to global climate change;

- provides the activities of the Intersectoral Coordinating Council under the Government of the Kyrgyz Republic for protection of citizens' health from harmful effects of tobacco;

- develops and implements the strategy for prevention of communicable and relevant chronic non-communicable diseases;

- implements the policy in the field of formation and execution of the consolidated program-based health budget;

- forms and determines the mechanisms for distribution of funds from the High Technology Fund, Technical Maintenance Fund, Epidemiological Fund and centralized measures;

- determines the amount of funding and provides the costing for healthcare organizations’ expenditures, working outside the Single Payer system;

- forms and pursues the state policy in the field of pharmaceutical activities, medicines supply of the population and healthcare organizations, organization of quality control, efficacy and safety of medicines;

- introduces and develops public-private partnerships in healthcare system;

- participates in development and implementation of international agreements on the oversight issues, works to attract grants and foreign investments into development of healthcare system, ensures implementation of international projects and programs;

  1. b) regulatory functions:

- develops and implements the unified system of primary medical accounting and statistical reporting of healthcare organizations, regardless of ownership;

- develops and implements Quality Management System, system for safety of health and pharmaceutical services;

- participates in development of standards for accreditation of healthcare organizations;

- organizes registration of medical and pharmaceutical workforce, monitors the flow of medical personnel in healthcare organizations;

- annually approves the plans for enrollment, agrees on the rules for enrollment to educational medical organizations;

- carries out licensing of private medical practice, as well as manufacture and sale of medicines, vaccines and serums, medicines and medical equipment;

- monitors the prices and pricing of pharmaceutical products in wholesale, retail pharmacy network, and healthcare organizations;

  1. c) functions of coordination, control and oversight:

- controls the activities of health care organizations in implementing national, state and targeted programs in the field of health protection and promotion, state benefits programs;

- jointly with local state administrations and local self-government bodies carries out general governance, coordination and control of the activities of healthcare organizations, regardless of their form of ownership, and takes joint measures to develop the sector;

- carries out intersectoral coordination, as well as interaction with public organizations, civil sector and media in implementation of national, state and targeted programs in the field of health care;

- coordinates implementation of measures for sanitary protection of the territory of the republic from import and spread of quarantine and high pathogen diseases;

- coordinates the conduct of epidemiological surveillance and organization of anti-epidemic, preventive measures for timely localization and elimination of outbreaks of communicable diseases and food poisonings;

- coordinates the work on ensuring biological safety of laboratories, working with pathogenic microorganisms;

- coordinates the work on supply of the population and public health care organizations with medicines and organizes interaction with the domestic pharmaceutical industry in the field of production and supply of medicines to the public and public health care organizations, in forming the Essential Drug List;

- provides control over the rational use of medicines, regardless of the source of procurement by health care organizations;

- controls the targeted use of the resources from the High Technology Fund, Technical Maintenance Fund, Epidemiological Fund and centralized measures;

- conducts internal audit of financial, operational processes in healthcare organizations, working outside the Single Payer system;

- exercises control over certification of specialists, managers of healthcare organizations and public servants;

- determines the state order and coordinates activities in the field of training and retraining of medical and pharmaceutical personnel, regardless of form and ownership and departmental subordination;

- coordinates the issues of under- and postgraduate, supplementary medical, pharmaceutical education and medical science, regardless of ownership and departmental affiliation, submits proposals for development of unified state educational standards, curricula and syllabus in medical educational organizations;

- coordinates the conduct of scientific research in health care, ensures the continuity of scientific and practical activities in health care;

- forms and participates in the work of coordination and other commissions, councils and task forces for health;

  1. d) functions of delivery of services:

- participates in addressing the issues related to emergency response in collaboration with other ministries and departments, organizes health care to the affected, provides mobilization training for health support for the population in peacetime and wartime;

- implements measures to promote population health, engage civil society, media, public organizations to build healthy lifestyle and increase citizens' responsibility for their own health and the health of other people;

  1. e) support functions:

- provides measures to improve the infrastructure and material and technical base of healthcare organizations;

- represents, in the manner, prescribed by the legislation of the Kyrgyz Republic, the interests of the Government in judicial bodies and other state bodies when considering supervised issues;

- organizes accounting of the receipt and use of financial resources, regardless of the source of funding, donations, grants and loans, received in health sector, and provides accounting and financial reporting on their use the health system;

- provides development and support of information and communication technologies of healthcare system;

- determines the needs and carries out centralized tender-based procurements of goods, works and services;

- represents, within its competence, the interests of the Kyrgyz Republic at international level, establishes and develops relations with health care authorities of other states and international organizations.

  1. Ministry’s Entitlements
  2. The Ministry is entitled to:

- make proposals to the Government of the Kyrgyz Republic on the main directions of state policy in the field of activity of the Ministry;

- develop draft regulatory legal acts and make proposals for improving the regulatory legal framework on the activities of the Ministry;

- develop and approve departmental acts of a non-normative nature in the field of healthcare;

- represent the interests of the Kyrgyz Republic in international negotiations, conclude international, intergovernmental and interdepartmental treaties (agreements) in the field of healthcare and sign bilateral or multilateral agreements and treaties on behalf of the Kyrgyz Republic, as well as agreements and treaties with regional and international organizations within the powers, defined by the legislation of the Kyrgyz Republic;

- receive information from ministries, administrative departments, local state administrations, local governments, and other organizations, regardless of ownership and departmental affiliation, on health protection and promotion, including the one in the field of socially significant and high-pathogen communicable diseases;

- hear reports on the activities of health care organizations, regardless of their ownership or departmental affiliation;

- according to the procedure make decisions within its competence on establishment and liquidation of state healthcare organizations, approve the structure and charters (regulations) of state/public healthcare organizations in accordance with the legislation of the Kyrgyz Republic;

- develop model charters (regulations) of healthcare organizations;

- delegate in the prescribed manner the certification of medical and pharmaceutical workers to professional medical public organizations, associations (unions);

- develop and implement measures for the restructuring and reorganization of enterprises, their bankruptcy and liquidation, within the framework of the powers granted by the Government of the Kyrgyz Republic;

- submit proposals to the authorized state body for state property management on privatization of buildings and premises of healthcare organizations, released through restructuring and rationalization;

- create coordination and advisory bodies (councils, commissions, groups), including interdepartmental ones, in the established field of activity, the regulations and composition of which are approved by the Minister;

- consider the cases of administrative offenses in the field of healthcare;

- develop and approve the incentive system for medical and pharmaceutical workers according to the legislation of the Kyrgyz Republic;

- cooperate with the authorized bodies in the field of health care of other states, international organizations and ensure implementation of agreements in the field of health protection and promotion;

- engage independent experts;

- attract funds from international organizations and institutions, grants from donor countries for implementation of state policy, related to the activity, falling within the competence of the Ministry;

- provide paid services in accordance with the legislation of the Kyrgyz Republic;

- support charitable and humanitarian activities of public organizations, associations, foundations, movements and individuals in the field of healthcare;

- organize and hold international congresses, meetings, seminars, conferences and competitions on health related issues;

- carry out publishing activities;

- exercise other powers, stipulated by the legislation of the Kyrgyz Republic in the field of healthcare.

  1. Organization of the Ministry’s activity
  2. The Ministry is headed by the Minister of Health of the Kyrgyz Republic (hereinafter referred to as the Minister), appointed and dismissed according to the legislation of the Kyrgyz Republic.
  3. The Ministry has established the highest administrative state position of Secretary of State, as well as the positions of Deputy Ministers.
  4. The Secretary of State is appointed and dismissed according to the legislation of the Kyrgyz Republic. The functions and powers of the Secretary of State are determined by the legislation of the Kyrgyz Republic.
  1. Deputy Ministers are appointed and dismissed by the Prime Minister of the Kyrgyz Republic upon the proposal of the Minister; they report directly to the Minister and organize the activities of the Ministry within the scope of their responsibilities.
  2. Minister:

- guides the activities of the ministry on the basis of unity of command;

- is the main manager of the republican health budget funds;

- bears personal responsibility for implementation of tasks, assigned to the Ministry;

- informs the President of the Kyrgyz Republic, Toraga of the Jogorku Kenesh (Parliament Speaker) of the Kyrgyz Republic and the Prime Minister of the Kyrgyz Republic about the health status  of citizens in the Kyrgyz Republic and submits appropriate proposals;

- represents the interests of the Kyrgyz Republic abroad, in international organizations, negotiates and concludes contracts within the limits of its authority;

- makes proposals to the Government of the Kyrgyz Republic on suspension of regulatory legal acts, that are contrary to the legislation of the Kyrgyz Republic in healthcare;

- assigns to the Secretary of State through agreement with the State Personnel Service of the Kyrgyz Republic, the functional duties on the issues related to sectoral policy of the Ministry;

- distributes duties between Deputy Ministers;

- submits proposals to the Government of the Kyrgyz Republic on candidatures for the positions of Deputy Ministers and the membership of the Collegium of the Ministry;

- gives agreement to the appointment and dismissal of the Secretary of State;

- makes submission of candidates for appointment and dismissal of managers of subordinate units to the Prime Minister of the Kyrgyz Republic in the prescribed manner;

- in the prescribed manner appoints and dismisses Deputy managers of subordinate units;

- appoints and dismisses managers of state/public healthcare organizations in accordance with the legislation of the Kyrgyz Republic;

- coordinates with the local state administrations or the relevant local authorities the appointment of managers of municipal health organizations;

- approves the structure and staffing of the Central Office and subordinate units in accordance with the legislation of the Kyrgyz Republic;

- approves the regulations on structural divisions of the Central Office, subordinate units of the Ministry in accordance with the legislation of the Kyrgyz Republic;

- issues Orders to be executed mandatorily by the Ministry system workers;

- gives instructions to the units, subordinate to the Ministry and monitors their implementation;

- manages the property and resources of the Ministry, concludes agreements in accordance with the legislation of the Kyrgyz Republic;

- appoints the positions of the Ministry public servants based on the proposal of the Secretary of State;

- makes decisions on the issues related to civil service in the Ministry based on the proposal of the Secretary of State in accordance with the legislation of the Kyrgyz Republic on public service,

- ex officio is the Head of Civil Defense of the Ministry;

- assigns class ranks to the Ministry employees in the prescribed manner;

- in the prescribed manner makes submissions of especially distinguished employees of the Ministry's system for awarding state awards, conferring honorary titles and for establishing pensions for special merits to the Kyrgyz Republic;

- makes decisions on bonuses for employees of the Ministry central apparatus and establishes personal increments to their official salaries in accordance with the legislation of the Kyrgyz Republic;

- encourages and imposes disciplinary sanctions on managers of state and municipal health care organizations, managers of organizations of higher and secondary professional medical education, as well as organizations, directly subordinate to the Ministry;

- exercises other powers and has other entitlements, granted to him by the legislation of the Kyrgyz Republic.

  1. A Collegium shall be formed for a joint discussion of policy documents on health protection, the most important issues of health care reform, medical education, science, as well as reports of public health officials.
  2. The Collegium shall be formed in the Ministry consisting of nine members: the Minister (Chairman of the Collegium), Secretary of State, Deputy Ministers who are ex officio members, representative of the Kyrgyz Republic Government Apparatus, and other senior officials of healthcare system.

The membership of the Collegium members (except ex officio members) shall be approved by the Prime Minister of the Kyrgyz Republic based on the proposal of the Minister.

  1. The Regulations on the Collegium and the rules of its work shall be approved by the Minister.
  2. Public Steering Council shall be created under the Ministry as advisory and supervisory body, formed with the aim of coordinated interaction between the Ministry and civil society.

The Decision of the Public Steering Council shall be recommendatory in nature.

  1. The Ministry shall have the Ethics Commission for civil servants, as well as the Personnel Service.
  2. To determine the priority areas of medical science and to conduct expert evaluation of research projects, the Scientific Council shall be created in the Ministry, consisting from the lead scientists of healthcare system. The Scientific Council shall carry out its activities in accordance with the Regulations, to be approved by the Minister.
  1. Final Provisions
  2. The reorganization and liquidation of the Ministry shall be carried out in accordance with the legislation of the Kyrgyz Republic.
